1. What Rollycar is
Rollycar is an online marketplace where users post and respond to ride-matching requests. Rollycar does not provide transportation services, employ drivers, own vehicles, or process payments for rides. All transportation arrangements and payments are made directly between users.
2. Eligibility
You must be at least 18 years old and able to enter into binding contracts to use Rollycar. You are responsible for keeping your account credentials secure and for all activity under your account.
3. The unlock fee
When a passenger and driver match, the passenger pays Rollycar a one-time unlock fee (currently $5.00) to reveal the other party's contact information. The unlock fee is non-refundable except as required by law or at Rollycar's sole discretion.
4. User responsibilities
- You are solely responsible for your own conduct and the accuracy of information you post.
- Drivers must hold a valid driver's license and carry the insurance required by their jurisdiction.
- You agree to verify the identity of any other user before traveling with them.
- You will not use Rollycar to transport unaccompanied minors, illegal goods, or anything that violates applicable law.
- You will not attempt to circumvent the unlock fee by sharing contact information through profile fields, ride notes, or offer messages.
5. Off-platform payment
Once a match is unlocked, payment for the ride itself is handled directly between users using the driver's own payment links (e.g. Stripe Payment Link, PayPal.me) or any other method the parties agree on. Rollycar is not a party to any off-platform payment, never holds ride funds, and disclaims all liability arising from those transactions.
6. No warranty
Rollycar is provided "as is" and "as available." We make no representations or warranties of any kind regarding the marketplace, the conduct of users, the safety or condition of any vehicle, the accuracy of any listing, or any aspect of any ride.
7. Limitation of liability
To the fullest extent permitted by law, Rollycar and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the platform, any ride, any other user, or any payment between users. Our aggregate liability for any claim arising out of these Terms is limited to the unlock fees you paid us in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless Rollycar, its operators, employees, and contractors from any claim arising out of your use of the platform, your interaction with another user, or your breach of these Terms.
9. Termination
We may suspend or terminate any account at any time, with or without notice, for any reason, including violation of these Terms.
10. Changes
We may update these Terms from time to time. The "Effective" date above shows when the current version took effect. Continued use of the platform after a change constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Florida.
